Kevin Clash, aka, Elmo for more than twenty-eight years has been cleared of sexual abuse charges filed by three men, Cecil Singleton, Kevin Kiadii and another man identified by initials “S.M.”– all who claim to have been abused by Clash (53) more than ten years ago.
The three men brought their cases to the New York Court of Appeals after a judge previously threw out the lawsuits on grounds the six-year statue of limitations had expired.
Alleging they did not realize the psychological effects of the abuse until 2012, the Court of Appeals ruled the men failed to provide evidence of such finding their arguments to be “without merit,” and the decision to dismiss affirmed.
Meanwhile, Clash is not completely out of the water. He’s still facing charges in Pennsylvania where accuser Sheldon Stephens, is suing him on claims he was sexually abused by Clash at sixteen.
Pennsylvania law is a lot more lenient towards statue of limitations so lets hope if the evidence supports a conviction, the victims will finally receive their justice.
I really don’t get the court system! These boys were all teenagers who obviously lacked the maturity and self-awareness to deal with sexual abuse and that should be considered!
Clash stands accused of abusing at least four teenage boys clearly showing a pattern. In certain cases, laws surrounding statue of limitations should be exempt. Especially since, statistics show most child victims never come forward if ever until well into their adult lives.
Think about the message this sends to victims of sexual abuse.
